YOU ACKNOWLEDGE AND AGREE THAT THE PLUGIN PROVIDED TO YOU (THE “PLUGIN”) IS LICENSED AND NOT SOLD TO YOU. WE PROVIDE THE PLUGIN “AS IS” AND WITHOUT WARRANTY OF ANY KIND, AND WE HEREBY DISCLAIM, TO THE FULLEST EXTENT POSSIBLE, ALL EXPRESS OR IMPLIED WARRANTIES, INCLUDING, WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, PERFORMANCE, ACCURACY, RELIABILITY, AND NON-INFRINGEMENT. WE FURTHER DISCLAIM THAT THE PLUGIN WILL MEET ALL OF YOUR REQUIREMENTS, THAT THE USE OF THE PLUGIN WILL BE UNINTERRUPTED OR ERROR-FREE, THAT PATCHES OR WORKAROUNDS WILL BE PROVIDED, OR THAT ERRORS WILL BE CORRECTED.
The Plugin is subject to the export laws and regulations of France, the United States of America, and/or other countries (cumulatively, the “Export Laws”). In downloading the Plugin, you agree that the Plugin will not be used, distributed, exported, re-exported, transferred, or transmitted (even if incorporated into other products) in violation of the Export Laws.
You further agree that before any installation or use of the Plugin by any end-user, you will collect and record all required end-user information and provide such information upon request in compliance with the Export Laws.
By clicking on the “Accept” button while installing, downloading, and/or otherwise by installing, downloading, or using the Plugin, you agree to these Export Control Terms and Conditions (the “Terms and Conditions”). If you do not agree to all the Terms and Conditions, promptly click on the “Cancel” button, cancel the installation or downloading, and destroy any written materials and other technical documentation related to the Plugin (the “Documentation”).
The individual clicking on the “Accept” or “Cancel” button (including, but not limited to, you, your employer, colleagues, and any agent engaged by you or your employer for installing the Plugin, or otherwise making this Plugin available to your organization) will be deemed to have full authority and power of attorney to assume the legal obligations under these Terms and Conditions.
You agree and certify that (a) the Plugin shall be used solely for telecommunications and/or enterprise (private or public) networks involving the following functions as individual or combined functionalities: telephony, office automation, commutation, routing, data transmission, encryption of data transmission, security and protection of network equipment, network equipment or network infrastructures management; and independently that these functions are implemented by wire or wireless link; and (b) the Plugin and Documentation will not be used, directly or indirectly, in the design, development, production, stockpiling, or use of chemical or biological weapons; the design, production, or use of missiles; or in nuclear-related activities.
You represent and warrant that the end-user is not located in, under the control of, or a national or resident of the following countries: Cuba, Iran, Sudan, Syria, North Korea, Ukraine, Russia, or Belarus.
You consent to obtain ALE International’s prior express written consent before using the Plugin or any Documentation outside the scope of the specifications for which they are intended, or for any military purpose.
You or the legal person you represent and act for, as the case may be, shall be solely responsible for obtaining any license which may be required under the Export Laws for downloading, delivering, or transferring the Plugin.
You acknowledge that you have read and understand the documents titled “ALE Guidance: Basic Guide to Export Control” and “U.S. Export-Control Guidance.” You can also find other information on “ALE International Export Control FAQ” and “ALE End User Software License Agreement.”
You further confirm that no unauthorized party is involved in the delivery, access, and/or use of the Plugin (or any item of it) and the Documentation.
You acknowledge that the Plugin and the Documentation are subject to the Export Laws, and you undertake to comply with the Export Laws where this Plugin is used, imported, exported, or re-exported. For the avoidance of doubt, your consent to the present Terms and Conditions, and any and all of your undertakings, obligations, and duties set forth herein, shall survive the download of this Plugin.
